Terms of Service — Fed AI

These Terms of Service ("Terms") form a legal agreement between you and Ali Abbassi trading as Fed AI (Australian sole trader, Brisbane, Queensland, Australia — "we", "us", "our") governing your use of the Fed AI iPhone app and the website at fedai.app (together, the "Service").

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Fed AI

You must be at least 18 years old. By using the Service you confirm you meet this age requirement and that any information you give us is accurate.

2. Your account

You are responsible for keeping your password secret and for everything that happens on your account. Tell us at support@fedai.app if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account if you failed to keep your password secure.

One account per person. Do not share your account with others.

3. Free access, subscriptions and billing

Fed AI is a free-to-download app with an optional paid subscription:

• Free access: the free tier remains available without a subscription, with up to 3 AI meal-photo scans per day and limits on history and weight charts.
• Pro access: monthly and yearly auto-renewable subscriptions unlock the same Pro features, including up to 20 AI photo scans per day, full history, macros, eligible sync and exports.
• Subscription pricing and offers: the current localized price, billing period and any introductory offer are shown in the app and Apple's purchase screen before you confirm. Signing up does not automatically start a seven-day trial.
• Billing and renewal: Apple charges your Apple account. A subscription renews automatically unless you cancel in Apple's subscription settings at least 24 hours before the period ends.
• Refunds: request an App Store purchase refund through Apple under its applicable policies; we cannot directly reverse an Apple charge.
• Usage controls: scan limits and temporary abuse-prevention rate limits apply; Pro does not include unlimited scans or priority processing.

4. What Fed AI is (and is not)

Fed AI provides estimates of the calories and macronutrients in food based on photos and text entries. These estimates are generated by AI and are not medically accurate.

Fed AI is not medical advice. It is a general-purpose tracking tool for healthy adults. Do not use Fed AI to make medical, therapeutic, or nutritional-treatment decisions. If you have any medical condition affecting diet — diabetes, eating disorders, allergies, pregnancy, coeliac disease, kidney disease, or any other — consult a qualified health professional before relying on Fed AI's estimates.

Nutrition estimates may be significantly wrong. The AI can misidentify food, misjudge portion size, and produce inaccurate calorie values. Use your judgement.

5. Acceptable use

You agree not to:

• Use the Service for anything illegal
• Upload photos containing other people's faces without their consent, or any illegal, offensive, or infringing content
• Try to reverse engineer, decompile, or scrape the App or backend
• Attempt to bypass rate limits, subscription checks, or authentication
• Impersonate anyone or misrepresent your identity
• Use the Service to build a competing product

We can suspend or terminate any account that breaches these rules.

6. Content you provide

You own the photos and data you upload. You grant us a limited, worldwide, royalty-free licence to store, transmit, and display that content solely to operate the Service for you. We do not use your content for advertising or training third-party AI models.

7. Intellectual property

The Fed AI name, logo, App design, and all associated intellectual property belong to us. You get a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

8. Third-party services

Fed AI uses Perplexity's API and its selected model provider for meal-photo analysis, Supabase for accounts and eligible synced data, Vercel for the backend, and Apple for iPhone subscriptions and optional Apple Health access. See our Privacy Policy for the current data-handling details. We will update these documents if a material provider or feature changes.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated estimates. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

Nothing in these Terms excludes any rights you have under the Australian Consumer Law or other mandatory consumer protection laws that cannot be excluded by contract.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the greater of AUD $50 or the amount you paid us in the 12 months before the claim.

We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages; for lost profits or data; or for damages arising from your reliance on AI-generated nutrition estimates.

Where the Australian Consumer Law applies and cannot be excluded, our liability for failure to comply with a consumer guarantee is limited (at our option) to resupplying the Service or paying the cost of having the Service resupplied.

11. Termination

You can delete your account at any time in Settings → Delete Account or by emailing support@fedai.app. We can suspend or terminate your account for breach of these Terms. Sections 6, 7, 9, 10, and 12 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. Any dispute will be handled by the courts of Queensland, unless the law where you live gives you a right to sue locally that cannot be excluded by contract.

Before starting formal proceedings, please contact us at support@fedai.app so we can try to resolve the issue. Most complaints are settled quickly and directly.

13. Changes to these Terms

We may update these Terms. If we make a material change we will notify you inside the App and by email at least 14 days before the change takes effect. Continued use after that date means you accept the new Terms.
